If a federally imposed gun ban is put in place that prohibits the sale of an AR-15 from a manufacturer or a dealer to a customer, it will prevent any further transfers of AR-15’s. The important thing to keep in mind with that scenario is that the lower receiver is the part of the AR-15 that will be banned. The lower receiver on an AR-15 is the only part of the firearm that has a serial number. Each state has regulations relating to the transfer of firearms and requirements, if any, for the registration of a firearm. In Florida, there is no registration of firearms. But to purchase any firearm from a dealer who has a valid Federal Firearms License (FFL) the customer must complete a Bureau of Alcohol, Tobacco, Firearms & Explosives (BATFE) Form 4473 which, if approved, allows for the transfer of a firearm from a dealer to the customer. The State of Florida and the BATFE do not have any idea what type of firearm you purchased when you fill out the 4473 (in Florida) and can only obtain that information from a dealer if that firearm was used in the commission of a crime or when investigating an individual with probable cause or reasonable suspicion.
Our “Beat the Ban” program is designed to allow the customer to purchase a rifle by taking possession of the complete lower receiver at the time of purchase with the upper receiver to be sent at a later date. The cause for the delay in delivery time for all TWS firearms is the availability of bolt carrier groups. Every company manufacturing and selling firearms faces a similar problem with the availability of one product or another. We currently have purchase orders in place for components and parts to manufacture over 1,000 rifles per month. Our delay in shipping is currently for the bolt carrier groups which are occasionally delayed by our suppliers which are in turn delayed by the much larger companies like Sig, Colt, FN and others attempting to buy everything on the market. Our orders have been in place for some time so we aren’t cut out – only delayed. If the gun ban goes into place like the one in 1994 in which “Assault Weapons” were banned, you will still be able to buy parts and pieces – even after the ban. If we have a similar ban implemented in the coming weeks or months, parts for AR-15’s will be still be available – except for the lower receiver.
Remember, your sale is for a rifle. Our invoice and the 4473 will reference the sale as a rifle. You are just taking possession of the complete lower receiver to “Beat the Ban.”

- Take possession of your lower receiver immediately (there are some jurisdictions in Florida that have 3-5 day waits if you do not have a Florida Concealed Weapons Permit – in that case you will be able to transfer you sale to a local dealer and pick up after three (3) business days)
- Receive your complete upper receiver in the coming months

- Contact your local FFL dealer and have him send his FFL license
- Make sure your dealer references your name
- Include name and telephone number of FFL dealer if possible
- Complete lower receiver will be sent in 1-2 weeks

What is an Assault Weapon?
BATFE Definition - Assault weapon” means any:
(1) Semi-automatic rifle that has the capacity to accept a detachable magazine and has one or more of the following:
(i) A pistol grip or thumbhole stock;
(ii) Any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;
(iii) A folding or telescoping stock;
(iv) A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel;
(2) Semi-automatic pistol, or any semi-automatic, centerfire or rimfire rifle with a fixed magazine, that has the capacity to accept more than 10 rounds of ammunition;
(3) Semi-automatic pistol that has the capacity to accept a detachable magazine and has one or more of the following:

Q: What was the semiautomatic assault weapon (SAW) ban?
The SAW ban was enacted on September 13, 1994, by PL 103-322, Title IX, Subtitle A, section 110105. The ban made it unlawful to manufacture, transfer, or possess SAWs. The law defined SAWs as 19 named firearms, as well as semiautomatic rifles, pistols, and shotguns that have certain named features. The ban was codified at 18 U.S.C. § 922(v). SAWs lawfully possessed on September 13, 1994, were not covered by the ban. There also were certain exceptions, such as possession by law enforcement.
Q: Was the SAW ban permanent?
No. The law enacting the ban provided that it would expire 10 years from the date of enactment, which was September 13, 1994. Therefore, effective 12:01 a.m. on September 13, 2004, the provisions of the law ceased to apply.

WEAPONS AND FIREARMS
1. The right of individuals to keep and bear arms is guaranteed under both the Second Amendment to the United States Constitution and s. 8, Art. I of the State Constitution.
2. A list, record, or registry of legally owned firearms or law-abiding firearm owners is not a law enforcement tool and can become an instrument for profiling, harassing, or abusing law-abiding citizens based on their choice to own a firearm and exercise their Second Amendment right to keep and bear arms as guaranteed under the United States Constitution. Further, such a list, record, or registry has the potential to fall into the wrong hands and become a shopping list for thieves.
3. A list, record, or registry of legally owned firearms or law-abiding firearm owners is not a tool for fighting terrorism, but rather is an instrument that can be used as a means to profile innocent citizens and to harass and abuse American citizens based solely on their choice to own firearms and exercise their Second Amendment right to keep and bear arms as guaranteed under the United States Constitution.
4. Law-abiding firearm owners whose names have been illegally recorded in a list, record, or registry are entitled to redress.
(b) The Legislature intends through the provisions of this section to:
1. Protect the right of individuals to keep and bear arms as guaranteed under both the Second Amendment to the United States Constitution and s. 8, Art. I of the State Constitution.
2. Protect the privacy rights of law-abiding firearm owners.
(2) PROHIBITIONS. – No state governmental agency or local government, special district, or other political subdivision or official, agent, or employee of such state or other governmental entity or any other person, public or private, shall knowingly and willfully keep or cause to be kept any list, record, or registry of privately owned firearms or any list, record, or registry of the owners of those firearms.
